CORAM: JUSTICE GIRISH KATHPALIA

J U D G M E N T (ORAL)

1. The accused/applicant seeks regular bail in case FIR No.329/2013 of PS IGI Airport for offence under Section 420/468/471 IPC.

2. Broadly speaking, prosecution case is that the present accused/applicant supplied a forged visa of Qatar to one Vishambhar Lal, who was apprehended at the IGI Airport on 05.11.2013.

BAIL APPLN. 4340/2026 Page 2 of 3 pages 3. Learned counsel for accused/applicant submits that there is no evidence against the accused/applicant and he is suffering incarceration since 30.07.2026.

4. Learned APP for State assisted by IO/SI Ramkesh accepts notice and submits that the only evidence against the accused/applicant is that he was declared a proclaimed offender on 23.08.2016 and in the FIR of the year 2013, he could be arrested only on 27.07.2026. Learned prosecutor, in all fairness, admits that there is no other evidence against the accused/applicant.

5. Merely because a person could not be located by the IO for service of any notice or even warrants, leading to a declaration of proclaimed offender against him, culpability cannot be attributed to such person.

6. Considering the above circumstances, I do not find any reason to deprive further liberty to the accused/applicant. Therefore, the bail application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the Trial Court/Duty Magistrate.

7. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
