M/S PATIL RAIL INFRASTRUCTURE PVT. LTD. v. UNION OF INDIA, THROUGH THE GENERAL MANAGER, NORTHERN RAILWAY

Delhi High Court appoints sole arbitrator for Patil Rail Infrastructure's contract dispute with Northern Railway

The court appointed Mr. Naveen Gupta, Advocate, as Sole Arbitrator under Section 11 for disputes under the 2024 running contract, with proceedings under DIAC rules. Parties may raise all pleas, including arbitrability and jurisdiction, before the arbitrator. The petition was disposed of.

Why it matters: At the Section 11 stage the court only checks prima facie existence of an arbitration agreement, leaving arbitrability and jurisdiction objections to the arbitrator.
