CORAM: JUSTICE GIRISH KATHPALIA

J U D G M E N T (ORAL)

1. Petitioners seek quashing of case FIR No. 205/2017 of PS Tilak Nagar for offence under Section 308/323/341/506/34 IPC on the ground that the respondents no. 2 and 3 have compromised the disputes with the petitioners.

2. Learned APP for State, assisted by IO/SI Mohit, accepts notice and strongly opposes the petition taking me through MLCs of respondents no. 2 and 3, reflecting multiple injuries, including fracture of skull.

CRL.M.C. 7772/2026 Page 2 of 2 pages 3. Learned counsel for petitioners submits that the respondents no. 2 and 3 are neighbours of petitioners and they have compromised the disputes without any monetary settlement, so the present FIR may be quashed.

4. Keeping in mind the extremely serious injuries inflicted on the respondents no. 2 and 3 by petitioners using iron rods, which were to such an extent that caused skull fracture, I do not find it a fit case to invoke inherent powers for quashing the subject FIR. The intensity of blows was so severe that it fractured the strongest bone of the human body and could have even been fatal. Exercise of inherent jurisdiction to quash such FIRs would certainly be not justified.

5. Therefore, the petition and the accompanying application are dismissed.
