The Race for Promotion
In competitive recruitment, fractions of a second can decide an applicant's career. Eleven police constables had appeared for the Limited Departmental Competitive Examination in 2023 to secure promotions to the post of Police Sub-Inspector in Maharashtra. After clearing the preliminary and mains exams, they underwent a rigorous physical test in April 2026, which included an 800-meter running race worth 50 marks.
The Disputed Milliseconds
Under the recruitment rules, male candidates clocking 2 minutes 30 seconds or less received 50 marks, while those clocking above that time received 44 marks. Initially, the day-end evaluation sheets recorded timing only in minutes and seconds, rounding off the results. All eleven constables were awarded 50 marks, which placed them securely in the provisional merit list published on 30 April 2026.
However, following objections from competing candidates, the Maharashtra Public Service Commission re-verified the digital electronic logs. The commission noticed that the official committee had omitted milliseconds during initial tabulation. When exact digital records were applied, each of the eleven constables was found to have exceeded 2 minutes 30 seconds, reducing their marks from 50 to 44. Consequently, they were excluded from the final selection list, and faster candidates were inducted.
Challenging the Shift
Aggrieved by their sudden exclusion, the constables approached the Maharashtra Administrative Tribunal, which dismissed their plea. They subsequently filed a writ petition before the Bombay High Court in 2026. Their senior counsel argued that revising declared marks based on milliseconds amounted to impermissibly 'changing the rules of the game' after the test had ended, without affording them any hearing.
Court Upholds Commission's Action
The Bombay High Court rejected the challenge and upheld the revision. The court observed that Rule 16 of the Commission's Rules of Procedure explicitly empowers it to rectify clerical errors, accidental slips, or omissions. Omitting milliseconds during on-ground tabulation was a clear administrative error, and relying on precise digital data did not introduce any new criteria or alter eligibility rules.
The bench highlighted that the constables never claimed they completed the race within 2 minutes 30 seconds, nor did they dispute the authenticity of the recorded digital timings. Holding that correcting a bona fide mistake to ensure faster candidates are selected does not cause legal prejudice, the High Court dismissed the petition.
Recruitment agencies are legally empowered to correct bona fide tabulation errors, and using precise objective data to fix an oversight does not violate recruitment rules.
