Bombay HC: Scrutiny Committee Cannot Reject Tribe Records on Mere Suspicion of Tampering

The student's struggle for caste validation
For young students pursuing higher education, securing a valid caste certificate is often essential to claim reservation benefits. A 20-year-old student from Solapur district found himself facing hurdles when the Scheduled Tribe Certificate Scrutiny Committee in Pune rejected his claim to the 'Koli Mahadev' Scheduled Tribe. Seeking relief, he moved the Bombay High Court to challenge the invalidation of his tribe status.
Why the committee rejected the claim
The student had relied on 43 documents, prominently including a school register entry of his paternal grandfather dated May 4, 1942, where the caste was recorded with the prefix 'M.' before 'Koli'. The Scrutiny Committee, acting on a report from its Vigilance Cell, concluded that the letter was interpolated or added later. Additionally, the committee noted that subsequent revenue and school records mentioned the caste simply as 'Hindu Koli' or 'Koli', and ruled that the student failed to clear the affinity test.
No visual guesswork without expert opinion
Examining the original records, the High Court emphasized settled Supreme Court principles holding that public documents cannot be treated as fabricated or interpolated on pure visual impression, ink shade, or conjecture. The committee had never sent the 1942 entry for examination by a handwriting or forensic expert, nor was there any statement from the school headmaster certifying an alteration. Consequently, rejecting a genuine pre-Constitution entry on mere suspicion was legally flawed.
Regional context and occupational records
Addressing the government's argument regarding entries marked merely as 'Koli', the bench referred to established precedents regarding Solapur and surrounding regions. Traditional 'Koli' communities engaged in fishing are predominantly found in coastal areas, whereas the student's ancestors resided in Solapur and engaged in agriculture, farm labour, and gathering forest produce. The court also reiterated that the affinity test cannot serve as an absolute litmus test to defeat concrete historical documentary proof.
The verdict and directions
Observing that the pre-Constitution entry carried superior probative value and could not be discarded lightly, the High Court quashed the committee's decision. The bench directed the Scrutiny Committee to issue the tribe validity certificate certifying the student as belonging to the 'Koli Mahadev' Scheduled Tribe within two weeks.
Caste scrutiny committees cannot discard ancient public records based on visual suspicion of tampering unless backed by expert forensic or handwriting analysis.
