Denied at the Finish Line

For skilled workers who spent over 30 years serving in a state irrigation department, reaching superannuation should have brought complete post-retirement peace. Instead, they faced a recurring bureaucratic hurdle. Having retired on 30 June across different years, they were denied their annual pay increment that formally fell due on 1 July, just a day after their exit from service.

The Legal Tussle in the High Court

The workers approached the High Court seeking the benefit of that final annual increment and a corresponding upward revision in their pensions. A single judge ruled in their favour, holding that increments earned by completing a full year of service cannot be snatched away. However, on an appeal by the state authorities, a Division Bench reversed this relief. The appellate bench held that because the workers had entered service as daily wagers, they could not claim parity with regular employees for such annual increments.

The Supreme Court Corrects the Course

The aggrieved employees escalated the fight to the Supreme Court. The top court closely scrutinised a vital Government Resolution from 1988, which had mandated that skilled daily wagers completing 10 years of service must be treated as permanent employees. Under this policy, these workers were brought into regular running pay scales, received allowances, and were guaranteed pensions and retirement benefits with a retirement age of 60 years.

Rejecting the state's stance, the court noted that the state could not ignore its own longstanding policy. Since these workers had been granted permanent status for all practical service and retiral benefits, classifying them strictly as daily wagers to withhold their earned increment was wholly untenable.

Timelines and Arrears

Applying settled legal principles, the court held that because the workers filed their petitions in 2022, they were entitled to enhanced pensions along with arrears for up to 3 years prior to the month of filing. The authorities were directed to calculate each worker's individual dues and disburse the amounts within 30 days. The court made it clear that while no retrospective interest is owed on arrears initially, any failure to pay within the stipulated 30 days will attract interest at 6% per annum until actual payment.

Workers conferred permanent status under government policy cannot be deprived of their legitimate annual retirement increments merely by labelling them as daily wagers.
